RENTAL AGREEMENT, WAIVER AND RELEASE OF LIABILITY

 

The following Terms and Conditions apply to all rental equipment orders from The Green Event Rentals LLC. By accepting delivery of the items listed in your Invoice, You (“Lessee” or “Renter”), confirm you hereby freely and voluntarily agree to execute this Agreement & Release under the terms listed as following. You acknowledge that you have read, understood and agree with all of the following Terms and Conditions. You acknowledge that items and equipment are in good condition and working order and agree to return all rental items upon termination of the rental period or at the Lessors’ (The Green Event Rentals) request. There will be absolutely no refunds after delivery of goods.

 

1. EQUIPMENT RENTAL TERM & AGREEMENT All equipment will be delivered to the Delivery Address. Lessee gives The Green Event Rentals representatives the right to enter the property for the delivery and pickup of all event rental equipment. All rented equipment is to remain on the property and may be removed only by the Lessor any time after the end of this Rental Agreement or due to severe weather. Any patio heater or tent should not be moved once it is set up by The Green Event Rentals representative at delivery. All equipment will be delivered clean and in good working order and all product specific safety rules will be reviewed with Lessee. Lessee agrees to keep all equipment rentals in the same condition as when received. If Lessee damages any rental item, lessee will pay for the repair or replacement cost at the discretion of The Green Event Rentals. Lessee is responsible for damage to equipment or items due to abuse, misuse, or negligence. Lessee agrees to pay the charges to repair equipment damaged, destroyed, lost or stolen.

 

2. ASSUMPTION OF RISK Lessee recognizes and understands that use of The Green Event equipment may involve inherently dangerous activities. Lessee understands and acknowledges that this Release discharges The Green Event Rentals from any and all claims of injury, illness, death, or property damage resulting from the possession and use of any The Green Event Rentals equipment or items.

3. WAIVER AND RELEASE OF LIABILITY Lessee does hereby release, forever discharge and hold harmless The Green Event Rentals LLC and its employees, members, and representatives from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Lessee’s possession and use of the rental equipment or items. Lessee understands and acknowledges that this Release discharges The Green Event Rentals, from any liability or claim that the lessee may have against The Green Event Rentals with respect to any bodily injury, personal injury, illness, death or property damage that may result from Lessees’ possession, use or misuse of any equipment or items belonging to The Green Event Rentals. You acknowledge and agree that, to the maximum extent permitted by law, the entire risk of use of The Green Event Rentals equipment, items or services, remains with you. The Green Event Rentals will not be liable for any incidental, special, punitive or exemplary or consequential damages or for the cost of procuring substitute equipment or services arising out of or in connection with this agreement or from the use of or inability to use The Green Event Rentals equipment, items or services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory and whether or not The Green Event Rentals has been informed of the possibility of such damage.

4. INSURANCE The Lessee understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment or items under this agreement is the sole responsibility of the Lessee.

5. PAYMENT Lessee acknowledges payment is due at the time of delivery. No deposits are required, however payment due in full at the time of delivery. Forms of payment may include cash, check, Venmo, or Zelle. Credit Card payment may be accepted as well with a 3% fee based on the total.

6. INDEMNIFICATION Lessee agrees that he/she will defend, indemnify and hold The Green Event Rentals, its officers, employees and representatives, harmless from and against any claims of liability resulting from the use of rented The Green Event Rentals equipment or items by the Lessee or any other persons using the equipment or item while in the Lessee’s possession including from/against any costs incurred due to claims of injury or attorney’s fees and related costs or injury involving the use and return of equipment.

7. SAFE OPERATION ACKNOWLEDGEMENT Lessee acknowledges that he/she has been instructed about and fully understands the safe operation of The Green Event rental equipment or items. Lessee agrees to observe all safety precautions.

8. RAIN/SEVERE WEATHER POLICY During periods of severe weather conditions, (i.e. rain, high winds, etc.), The Green Event Rentals reserves the right to cancel your reservation or pick up any equipment that is exposed to the severe weather. If rain or severe weather is forecasted, Lessee has the option of canceling the order or reservation by 9 AM PST on the day before the event or when items are delivered, whichever occurs first, without incurring a cancellation fee.

9. RENTAL EQUIPMENT PHOTOGRAPHY POLICY Lessee acknowledges that The Green Event Rentals employees or representatives may photograph rental equipment while under Lessees possession at the event delivery location which may or may not be Lessees private property. These photographs are used to document the condition of The Green Event Rental equipment on delivery and upon pickup and/or return. These photographs may also be used online at The Green Event Rentals company website (www.thegreeneventrentals.com) at The Green Event Rentals discretion. Any elements that can or may personally identify Lessee and/or Lessees guests will be removed from the photograph before being uploaded to the website.

10. OTHER Lessee expressly agrees that this Rental Agreement is intended to be as broad and inclusive as permitted by laws of the State of California and that this Agreement shall be governed by and interpreted in accordance with the laws of the State of California. Lessee agrees that any clause or provision shall not otherwise affect the remaining provisions of this Agreement. Lessee agrees to pay all Attorney’s fees and court costs incurred by enforcing this Agreement. Any errors in this agreement are subject to correction and Lessee hereby agrees to re-execute any document that requires correction.

11. PRIVACY POLICY Your use of our website, www.thegreeneventrentals.com and our services is governed by our Privacy Policy as follows: The Green Event Rentals LLC knows that you care how information about you is used and shared and so we have provided you with our Privacy Policy here. If you have any questions, please feel free to email us at thegreeneventrentals@gmail.com. The Green Event Rentals uses the information you provide to fulfill your order and to communicate with you via email or phone about your order. When you email or text us to our email address or phone number, we use your email address and name to respond and follow up to your inquiry. We do not sell, trade, or otherwise transfer your personal information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety

12. TENT, TABLE & CHAIR RENTAL AGREEMENT Lessee agrees to return the tables and chairs rented in the condition they were delivered and received. The Green Event Rentals agrees to deliver clean tables and chairs in working order. The Green Event Rentals will neatly stack the tables and/or chairs at the event location. Set up is Lessee or renters’ responsibility. Lessee agrees to have the chairs neatly stacked at the predetermined time of pickup. If any table or chair is damaged, lost or stolen during the rental period, the renter agrees to pay $100 per damaged, lost or stolen table and/or $20.00 per damaged, lost or stolen chair and/or $500 per damaged, lost or stolen tent. The lessee pick-up and return of rental equipment at the Green Event Rentals location is at the discretion of the Green Event Rentals and is based on a case-by-case basis. If approved, lessee assumes all risk and damage that may incur with the transportation of the rental equipment for the rental equipment itself and lessee’s vehicle. Lessee to ensure that the rental equipment is secured properly during transportation.

 

General Liability Release of Claims Effective immediately upon execution, I, for and in consideration of the payment to me of, the receipt and sufficiency of which is hereby acknowledged, do hereby release and forever discharge The Green Event Rentals LLC, their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which I now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the following: Personal injury or property damage arising from the use of tents, tables, and chair rentals. It is understood and agreed that this payment is made and received in full and complete settlement and satisfaction the causes of action, claims and demands mentioned herein; that this Release contains the entire agreement between the parties; and that the terms of this agreement are contractual and not merely a recital. This Release may not be altered, amended or modified, except by a written document signed by both parties. Furthermore, this Release shall be binding upon the undersigned, and his respective heirs, executors, administrators, personal representatives, successors and assigns. This Release shall be subject to and governed by the laws of the State of CA. This Release has been carefully read and fully understood. The terms have been explained to me and I am freely, knowingly and voluntarily entering into this Release.
